有关家庭暴力的若干思考

    摘要：家庭暴力是发作在家庭成员之间的暴力行为。日益严峻的家庭暴力损害了受害者的身心健康，侵犯了受害者的合法权益，破坏了社会安稳和开展，已引起全社会的广泛注重。为了给予家庭暴力的受害者更全面、更详细、更恰当的帮忙，以获得更好的社会作用，有必要树立法令、社会、心思各层面的社会支持系统。
    我国家庭暴力的研讨存在缺乏，不只体现为政府决议计划部分和一般大众对这一问题的忽视，还体现在学术研讨上，短少有关家庭暴力实证查询的数据，有关家庭暴力的论文和著作也不多见。而在实践中，跟着人们思想观念的改变和社会的变迁，躲藏在家庭中的暴力违法逐步显露出来，有关家庭暴力事件的报导日益频繁。这种情况不只要求决议计划部分可以注重这一问题，更要求学术界能研讨并供给家庭暴力的规范，经过实证的查询，剖析家庭暴力的原因，提出相应的防备对策，为立法组织拟定和完善有关家庭暴力违法的法令供给理论上的根据。基于此，笔者就此问题打开论说，以期抛砖引玉，期望更多的学者可以注重我国的家庭暴力问题。

    Abstract ：The act of violence among kinsfolks takes place in family‘s violence . The serious family violence has endangered the victim’s physical and mental health， has infringed the victim‘s legitimate rights and interests day by day， have destroyed the social stability and development， has already caused the extensive concern of the whole society. In order to offer in an all-round way ， more concrete ， more proper assistance of victim of violence to the family， in order to make better social effect ， must set up the law ， society ， society of psychology every aspect and support the system . The research of the violence of Chinese family exists insufficiently， is not merely shown as government’s decision department and ordinary masses‘ neglect of this question， still display it on the academic research， lack the data investigated about family’s violence real example， thesis about family‘s violence and writing rarly. In practice， with the change of the concepts of people and changes of the society， the violence crime hidden in the family reveals out apparently gradually， the report about incident of violence of family is frequent day by day. This kind of state not merely requires the decision department to pay attention to this question， require the academia to study and offer a standard of violence to the family even more， through the investigation of the real example ， analyse the reason of family’s violence ， put forward the corresponding prevention countermeasure， offer the basis in theory for the fact that the legislative body makes and improves the law about family‘s violence crime. Because of this， I launch describing on this question， am in the hope of casting a brick to attract jade， hope more scholars can pay close attention to the family violence question of China .
    虽然家庭暴力是一个陈旧的问题，可是即便在西方，人们开端注重并系统研讨这一问题，也从 20 世纪 60 时代开端的。这是由于家庭暴力不单纯是暴力违法，它总是和人们的思想观念、家庭的道德价值、社会的传统文化交错在一起的，被有意无意地掩盖起来，乃至被认为是正常的工作。美国的违法学家在进行家庭暴力违法研讨时，都企图答复，“为什么在如此长的时间里，在有足够的依据证明家庭是最严峻的暴力场所的情况下，一切的公共组织和私家集体都会忽视它的存在呢 ？” ①
